Scenario 2 - no because it isn't the team finishing top that's promoted - there's a play-off system.
If Toulouse finish the season in 1st place, will they be entitled to play the playoffs games at Home, if not then that makes a mockery of the playoffs system.I bet the RFL, hadn’t thought of that possibility when they were messing up the system, I know it’s easy to criticise in hindsight, but these people are well paid to make the right decisions in the first place.

We already know that many teams can't travel to TO - that may also be the case in the play-offs.
It's not TOs fault and they shouldn't be penalised for it. The system isn't "fair", but it's probably the "fairest".
Why are you blaming the RFL - the system was devised WITH the clubs, not imposed upon them.

You may be correct with that statement, I haven’t seen any statements to that effect, if this is another case of the tail wagging the dog, boy, do we need a new dog, get the old dog put down.

I'll give you one example...
"The clubs held a virtual meeting last Friday, and while agreeing on the need to maintain flexibility given the ongoing uncertainty surrounding Covid-19, all recognised the importance of providing players and supporters with a clear plan. ... It has also been agreed that the league table in each competition will be determined on a points percentage system, as with Betfred Super League in 2020, in recognition of the likelihood of Covid-19 remaining a factor."

Thanks for posting that. Not sure why you included the link, as that only refers to Championship and league , although the last paragraph you wrote above does say as with Betfred Super League 2020. I do wonder what the voting was, For and Against per clubs.

Eh? The discussion is about how/when/why the % system was introduced and how it affects TO & Fev.
The clubs discussed and agreed it, including Fev. It wasn't imposed on them by the RFL, SL or anyone else.
I randomly picked Rams press release, where they say that the Championship, in 2021, will be settled on a % basis, as was SL in 2020.
The link is because you said you'd never seen such a statement. Now you have.
