I would guess this is why we have not gone down the litigation route because it would be pointless and a waste of money unless of course those in the know can confirm what they consider the council to have failed to do.
The reason we're no closer to the trigger point is because WMDC conspired with YCP to take Newcold out of the UU; it therefore did not contribute to the required acreage to trigger their obligation to do what HM inspector told them they had to do in order to develop that land.
A letter of intent should focus on that - as it's the murkiest part of the whole thing so far, especially with WMDC's mysterious legal advice, which Peter Box is on record as saying they took, but they've never actually been able, or willing, to provide any evidence of; because it was a lie.
