In theory yes, nothing to do with it. However, in practice, if injury does occur there does tend to be more emphasis put on the incident, and more often than not, a more lengthy ban.
e.g Mr Mason of Hudds, runs in to punch a goons player during a dust up-result no ban, just a fine.
Do you really think if he'd have broken someones jaw he'd have got the same treatment from the disciplinary?
