Think there are certain deadlines within the competition, so it's more a matter of when the player is first registered with a club rather than whether he has previously played in the competition.
Shouldn't it be that you can only use players that are already at and playing for the club when the competition starts. By that I mean they must have already played a competitive game for their club when their club enters the Cup.

In the case of the players at Gateshead that is untrue. They have only played a couple of games, and these are since their club had already played twice in the Cup.
